Ah the Compacts!! The solution to the waste problem  gone sour

Appointed by the governor, two members from each party state serve on the Commission, as do four members from each host state.For further explanation of the compacts see President Reagans letter below)

I was appointed by the Governor to serve on the committee in Delaware's decision concerning low level nuclear waste.

When the proposal was made for Delaware to join the Appalachian compact, I was against it. I made the following motion"

Whereas Delaware's nuclear waste consists only of medical waste the expense of joining the compact should be weight against going alone. 

The committee voted with me , but the vote was disregarded and the pact was signed.(today I would question the legality of this action)

Realizing how badly the "compact" concept failed All over the country I sent the following e mail to Dr.Harry Otto who was designated Delaware's representative. Here is his reply

Hello Harry:

Long time no see (or hear), I hope all is well with you. As you can well imagine I am still very busy on the national level concerning nuclear power 
I have not done much concerning low level waste other then help the effort to keep it out of our landfills after repeated  attempts to de-classify. So far so good. We generated over 10.000 e mails at the last attempt.
The new developments at Barnwell However tells me that the "constipation" in the nuclear fuel cycle is not confined to rad waste.
I wonder if you could tell me about the status of the Appalachian compact.
1) Does PA have a designated site by now                 No, the siting project was tabled several years ago. The project had progressed to the point of announcing five possible locations that would have been subject to detailed Environmental Impact Evaluations.
2) what is DE's financial contribution to the compact   None for several years now. To cut expenses, we closed the Commission office, released the CEO from his contract, released off his secretary, sold off the office furniture, provided for storing the Commission records, and established provisions to reactivate the office when needed.  The Commission meets annually -- next meeting at 10:00 a.m. on November 9 at the Harrisburg Hilton.
3) does our medical waste go to PA at this time         No 

      Appalachian total 13.70% 
      Delaware <.01% Pennsylvania** 13.40% 
      Maryland 0.29% West Virginia <.01% 

As you know I was against joining a compact , I thought due to the small volume we could take care of it.(I even had the perfect place for it: The tip of Artificial Island which belongs to Delaware)

Today, I am signing into law H.R. 3025, legislation granting congressional consent to the Appalachian States Low-Level Radioactive Waste Compact.

 

In granting its consent to the creation of this Compact, the Congress has given its approval to yet another effort at the State level to resolve concerns regarding radioactive waste. More than three-quarters of the States have now entered such compacts, demonstrating the major progress that has been achieved in addressing the problem of radioactive waste. Our continued success in this effort, along with the passage of last year's amendments to the Nuclear Waste Policy Act, underscore this Nation's commitment to take those actions needed to ensure the future availability of nuclear power as an energy supply option for this country. Continued growth in the availability of nuclear power promises significant benefits to our energy security, decreasing this Nation's reliance on insecure sources of foreign oil.

 

In signing this bill, I note that one of the many provisions of the Compact suffers from a constitutional defect in that it assigns Federal law enforcement responsibilities to the Appalachian States Low-Level Radioactive Waste Commission, but does not require that the Commission be appointed in a manner consistent with the Appointments Clause of the Constitution. Any effort by the Commission to enforce Federal regulations would contravene the Constitution. While I hope that no such effort would occur, I expect the Nuclear Regulatory Commission to take note of and report to the Attorney General on any such actions of the Commission in this area.
